Swiftrics Acceptable Use Policy

1. Purpose
This Acceptable Use Policy (the "AUP") describes activities and content that are prohibited on the Swiftrics service operated by Pelton Solutions LLC ("Swiftrics," "we," "us," "our"). The AUP is incorporated by reference into the Swiftrics Terms of Service and applies to anyone using the Service, including Customers, anyone acting under a Customer's Account, and visitors to Customer Sites whose conduct violates this AUP.
By using the Service, you agree to comply with this AUP. Violations may result in content removal, Account suspension or termination, removal of Customer Sites and Domains, suspension of email sending, and reporting to law enforcement or rights holders, as further described below.
This AUP is not exhaustive. Swiftrics may determine, in good faith, that conduct or content not specifically listed here is nonetheless a violation, and may act accordingly.
2. Prohibited Content
You must not use the Service to host, transmit, distribute, or link to content that:
2.1 Is illegal or supports illegal activity
- violates any applicable federal, state, or local law in the United States;
- depicts, promotes, or facilitates terrorism, violent extremism, or other serious crimes;
- constitutes fraud, identity theft, or financial scams (including investment, romance, advance-fee, business-impersonation, and tech-support scams).
2.2 Sexually exploits or endangers minors — absolute prohibition
- child sexual abuse material (CSAM);
- content that sexualizes minors or depicts minors in a sexual context, in any form (illustrated, animated, AI-generated, or otherwise); or
- grooming, solicitation, or sextortion of minors.
Swiftrics has zero tolerance for CSAM. We report all such content to the National Center for Missing & Exploited Children (NCMEC) as required by federal law (18 U.S.C. § 2258A) and cooperate fully with law enforcement. Accounts found hosting such content will be terminated immediately and irrevocably, and we may preserve content, account data, and connection logs as required by law.
2.3 Infringes intellectual property
- content that infringes any third party's copyright, trademark, trade secret, patent, right of publicity, or right of privacy;
- pirated software, music, video, books, or games; tools for circumventing technical protection measures (DMCA § 1201 violations);
- counterfeit goods or services.
If you believe content on the Service infringes your copyright, see the DMCA process described in our Terms of Service (Section 11).
2.4 Promotes hate, harassment, or violence
- content that promotes violence against, threatens, or incites hatred toward a person or group based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, or other protected characteristic;
- content that harasses, bullies, or stalks specific individuals;
- doxxing — publishing personal contact, address, or identifying information of a private individual without consent and in a way intended to cause harm or harassment;
- content that incites imminent violence or self-harm.
2.5 Is defamatory or invasive of privacy
- content that contains knowingly false statements of fact that damage a third party's reputation;
- content that reveals private, intimate, or otherwise sensitive information about an identifiable individual without lawful basis and consent (including non-consensual intimate imagery / "revenge porn").
2.6 Is regulated or restricted
Depending on the category, the following content may be permitted only with additional verification, opt-in, age-gating, or compliance with specific laws and Upstream Registrar / payment-processor rules. Swiftrics may, at its discretion, prohibit or restrict any of the following:
- Adult or sexually explicit content for adult audiences. Allowed only with age verification, clear labeling, and full compliance with 18 U.S.C. § 2257 record-keeping where applicable, and only if the relevant payment processor and Upstream Registrar permit. Content depicting non-consent, minors, or other illegal acts remains prohibited under Section 2.2 and elsewhere.
- Gambling, lotteries, sports betting, real-money gaming — only with verifiable licensing in every jurisdiction targeted.
- Cannabis, CBD, hemp, kratom, vape products — only as permitted by applicable law in every jurisdiction targeted; product claims must comply with FDA, FTC, and state regulations.
- Firearms, ammunition, weapons, and accessories — limited to lawful sales by properly licensed dealers; no transfer of firearms, ammunition, or regulated parts through the Service, no "ghost gun" content.
- Pharmaceuticals, controlled substances, prescription products — limited to lawful, licensed providers; no shipment without prescription where required.
- Cryptocurrency / digital assets — informational sites are generally allowed; promotion of pump-and-dump schemes, unregistered securities offerings, fraudulent ICOs/IDOs, "rug pulls," or mixers used to launder funds is prohibited.
- Get-rich-quick, MLM, payday-loan, and similar high-risk schemes — prohibited where deceptive or unlawful; permitted only where they fully comply with FTC and state consumer-protection rules.
- Hate symbols, regalia, and merchandise of designated extremist organizations — prohibited.
- Protected Health Information (PHI) / HIPAA — Swiftrics is not a HIPAA-compliant platform and will not sign a Business Associate Agreement (BAA). You may not use the Service to create, receive, maintain, or transmit PHI subject to HIPAA, or to operate any Customer Site or workflow that would require Swiftrics to act as a Business Associate.
We may refuse to host any otherwise-legal content category if it presents disproportionate risk to Swiftrics, our vendors, our payment processor, the Upstream Registrar, or our other Customers.
2.7 Is malicious or deceptive
- malware, viruses, worms, trojans, spyware, ransomware, or any other software designed to disrupt, damage, or gain unauthorized access to systems, data, or networks;
- phishing pages, fake login portals, fake banking interfaces, or content designed to deceive visitors into disclosing credentials, payment information, or personal data;
- cryptojacking — running cryptocurrency mining scripts on visitors' devices without informed consent and in a way that materially uses their resources;
- pages designed to deceive search engines or users about the origin or nature of content (cloaking, doorway pages, large-scale typosquatting).
3. Prohibited Activities
You must not use the Service, or any Customer Site or Domain on the Service, to:
3.1 Send unsolicited email or messages ("spam")
- send unsolicited bulk commercial email in violation of the CAN-SPAM Act (15 U.S.C. § 7701 et seq.), Canada's Anti-Spam Legislation (CASL), or comparable laws;
- send email that disguises or hides its origin, uses misleading "From," "Reply-To," or subject-line information, or omits a valid postal address or working unsubscribe mechanism;
- send to addresses harvested from public sites, scraped, purchased without consent, or otherwise obtained without permission;
- send transactional or relationship messages used as a vehicle for unrelated marketing;
- send SMS / text messages in violation of the TCPA or state texting laws.
3.2 Attack, probe, or interfere with systems
- attempt to gain unauthorized access to Swiftrics systems, Customer Accounts, Customer Sites, or third-party systems (including by credential stuffing, brute force, password-reuse exploitation, or social engineering);
- probe, scan, or test the vulnerability of systems or networks without express written authorization;
- conduct, facilitate, or participate in denial-of-service or distributed-denial-of-service attacks;
- bypass or interfere with any rate limit, authentication, access control, or other security measure;
- intercept, monitor, or interfere with traffic of other users.
3.3 Abuse the platform or its resources
- run cryptocurrency mining on Swiftrics infrastructure (whether visible to visitors or in the background);
- use the Service primarily as a file-storage, file-sharing, or bulk-distribution backend unrelated to a Customer Site (we are a website platform, not a CDN/file host for arbitrary content);
- consume disproportionate compute, bandwidth, storage, or other resources in a manner inconsistent with the spirit of your plan, where Swiftrics has reasonably determined that the use is abusive (see Section 5);
- automate Account or Domain creation, sign-ups, or other Service interactions in ways not expressly permitted;
- attempt to reverse engineer, decompile, or extract the source code of the Service except as expressly permitted by law.
3.4 Misuse Domain registrations
- register a Domain in bad faith, including cybersquatting (registering a domain primarily to sell it to a trademark holder), typosquatting at scale, or registering a domain principally to disrupt a competitor's business;
- use a Domain to impersonate a person, brand, government, or organization without authorization;
- use a Domain in furtherance of phishing, malware distribution, fraud, or other prohibited activities;
- provide knowingly false WHOIS / RDAP Registrant information or fail to keep it current;
- circumvent the Upstream Registrar's, registry's, or ICANN's policies, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP) or Uniform Rapid Suspension (URS);
- use the Service to operate a domain-tasting, domain-warehousing, or large-scale automated domain-flipping business in violation of registry rules.
3.5 Impersonate or deceive
- impersonate Swiftrics, our personnel, or any other person, organization, or entity;
- create or operate fake support pages, fake account-recovery flows, or other content designed to confuse Customers about their relationship with Swiftrics or any other legitimate provider;
- forge headers, sender identities, or other technical metadata to misrepresent the origin of content or communications.
3.6 Harm minors
- collect personal information from a child under 13 in violation of the Children's Online Privacy Protection Act (COPPA) through a Customer Site you operate;
- target advertising or behavioral profiling at minors in violation of applicable law;
- knowingly host or distribute content that targets minors for grooming, exploitation, or harm.
(Note: the Swiftrics Service itself is offered only to Customers who are 18 or older — see the Terms of Service, Section 3.)
3.7 Resell or repackage the Service improperly
- resell, sublicense, or repackage the Swiftrics platform itself to third parties without our written permission. (Operating your own Customer Site on the Service, including a Customer Site that serves your own customers, is normal use and is permitted within the limits of your plan.)
4. Email-Specific Rules
The Service includes outbound email features (for example, contact-form notifications), delivered through our email infrastructure (Amazon SES). If you send email through the Service, or from a Domain registered or managed through Swiftrics:
- the email must comply with CAN-SPAM (clear identification of commercial nature, accurate header information, working unsubscribe within 10 business days, valid postal address) and, where recipients may be in Canada, CASL;
- you must have a lawful basis for emailing each recipient (e.g., consent, an existing customer relationship, or another lawful basis under applicable law);
- you must maintain a current suppression list and not email anyone who has opted out;
- you may not send through open relays or otherwise route through systems you do not have authorization to use;
- you must promptly cooperate with abuse and spam complaints and take corrective action; and
- you must configure SPF, DKIM, and DMARC appropriately if sending at any meaningful volume.
Deliverability monitoring. To protect platform deliverability and our other Customers, Swiftrics monitors per-site bounce rates and spam complaints and maintains a global suppression list. Persistent or material bounce/complaint rates may result in throttling, pausing, suspension, or permanent disabling of your email sending, removal of associated Customer Sites and Domains, and Account termination — with or without prior notice. See the Terms of Service, Section 10.
5. Reasonable Use of Resources
Swiftrics plans are sold based on assumptions about normal Customer Site usage patterns. While we do not publish specific resource caps as a hard contractual limit, we may consider use of the Service "abusive" or "outside the spirit of the plan" if it:
- consistently consumes resources at multiples of typical Customer usage on the same plan without a clear, legitimate business reason;
- functions primarily as a CDN, backup target, video distribution platform, or other use case the plan was not designed for;
- causes degraded performance for other Customers;
- generates persistent abuse complaints, security alerts, or copyright/DMCA notices; or
- is part of a pattern of behavior that would normally trigger enforcement under another section of this AUP.
We will generally contact you before taking action for resource-based concerns and give you a chance to either reduce usage or upgrade to an appropriate plan.
6. Reporting Abuse
If you believe a Customer Site, Domain, or other use of the Service violates this AUP or applicable law, please report it:
- General abuse: legal@swiftrics.com
- Spam / phishing: legal@swiftrics.com with subject "Phishing / Spam Report"
- CSAM: legal@swiftrics.com with subject "CSAM Report" (we also report to NCMEC as required by law)
- DMCA copyright notices: see the procedure in the Terms of Service (Section 11)
Please include URLs, screenshots, headers (for email abuse), and a description of the violation. We may need to share certain information with the reporter, the affected party, the Upstream Registrar, or law enforcement, as appropriate.
We do not guarantee a specific response time, but we treat urgent abuse — especially CSAM, ongoing phishing, and active malware distribution — as high priority.
7. Enforcement
When we determine, in good faith, that this AUP has been or is being violated, we may take one or more of the following actions, with or without notice depending on severity:
- request that the Customer remove or modify specific content;
- remove or disable access to specific content, pages, or features;
- suspend or terminate specific Customer Sites or Domains;
- throttle, pause, or disable email sending;
- suspend or terminate the Customer's entire Account;
- preserve content, account information, and connection logs to comply with law and legal process;
- report the matter to law enforcement, the Upstream Registrar, ICANN, NCMEC, payment processors, anti-abuse clearinghouses, or other appropriate parties; and
- recover from the Customer any costs Swiftrics incurs as a result of the violation (including legal fees and third-party fees), to the extent permitted by the Terms of Service.
For Domain-related violations, enforcement may also include locking the Domain, transferring it back to the Upstream Registrar, suspending DNS, or taking other actions required or permitted by ICANN policy.
We make enforcement decisions in our reasonable discretion. We may decline to enforce in any particular case without waiving our right to enforce in others.
8. Appeals
If you believe an enforcement action was taken in error, you may appeal by emailing hello@swiftrics.com (subject "AUP Appeal") within fourteen (14) days, including your Account email, the action taken, and an explanation of why you believe the action was incorrect. We will review the appeal and respond within a reasonable time. Appeals are not available for actions required by law (for example, removals required by valid court order or in response to verified CSAM).
9. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated with reasonable advance notice (by email and/or in-product notice). The "Last Updated" date above reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated AUP.
